TERMS AND CONDITIONS
 

1. Conclusion of the contract
The offer of products is non-binding; by sending the order the customer is submitting a binding offer to buy by clicking on the order button in the last step of the ordering process. This offer to buy is accepted and confirmed automatically with a confirmation e-mail (“order confirmation”). If “payment in advance” has been agreed, we are authorised to request your payment through bank transfer within ten working days. If you fail to do so the order will be deleted from our system automatically. You will be informed about the cancellation of the order by e-mail. The text of the contract is included in the order confirmation mail and is also filed in the system of BFB Handels GmbH. It cannot be viewed online but may be provided on request, solely by e-mail.

2. Product prices
The prices for all available products on www.youtailor.co.uk include 17.5% VAT. In the event that the VAT rate changes we reserve the right to change the prices accordingly. Apart from the stated total price, customers of BFB Handels GmbH are not invoiced any further surcharges, except for the shipping costs which are stated separately for each order. Products are shipped without any custom charges only within the European Union.

3. Validity of the agreement
This contract is valid only, as long as there is no additional agreement confirmed either in writing or by electronic means between the customer (yourself) and BFB Handels GmbH. For any other agreement we would ask you to contact and inform us prior to placing your order.

4. Payment of the products
Four payment methods are available:

  • Credit card or debit card (Visa, Mastercard, AMEX, JCB, Diners Club, Maestro, Solo Card, Visa Debit, Visa Electron);
  • DIRECTebanking;
  • PayPal;
  • Bank transfer to our bank account in advance, i.e. before the order is accepted;
Your purchase order will be processed once the value of the order has been fully paid and the amount payable received in our account. If the credit card payment mode is chosen, the amount payable is debited directly from your credit card.

5. Security and cookies

BFB Handels GmbH does not use any cookies, which would allow any third party to make use of your account or trace your personal web surfing habits. Cookies are needed only to identify the products in your shopping cart. Third-party cookies are used only to develop statistics on the use of our web pages. They do not carry any personal information. All transactions with banks are encrypted.

6. Delivery/shipping cost
Our hand-made shirts, blouses, suits and boxer shorts are normally delivered within three to five weeks. However, these delivery times cannot be guaranteed. In some cases, delivery may be delayed by a few days when the desired fabric is not available. We take all possible steps to guarantee a delivery within the aspired delivery time span. 7. Cancellation and its consequences

You may cancel your declaration to conclude a sales contract within two (2) weeks without giving any reasons, either in writing (e.g. by letter, fax or e-mail) or if the product is placed at your disposal prior to the expiry of this period by returning the product. The period begins upon receipt of this instruction in text form pursuant to Section 5e of the Austrian Consumer Protection Act, but not before receipt of the products at the receiver (in the recurring supply of similar products before receipt of the first partial delivery) and also not meeting our information requirements. In order to consider and keep the limitation period, it shall be sufficient to send punctually the cancellation notice or the products. The cancellation notice must be sent to BFB Handels GmbH, Engerthstraße 126/1, A-1200 Vienna or by e-mail to customers@youtailor.net. In the event of effective cancellation, the services received by either party shall be returned and any benefits that may have been accrued shall be released. Should the customer not be able to return the products or only return them partially or in a deteriorated condition then the customer will be obligated to value replacement. In the case of products surrendered this does not apply if the deterioration of the products is brought about solely by a tryout thereof - such as would have been possible for you e.g. in a retail shop. For the rest, you may avoid any duty to provide compensation for any deterioration of the products caused by the intended use, by not using the products as your own property and refraining from all actions that may affect its value. Products capable of being sent by parcel post should be returned to us at our risk. You have to bear the cost of returning if the products ordered are in conformity with those ordered, and if the price of the products returned does not exceed an amount of 40 Euros or if in the case of a higher price of the products you have not yet performed the service in return or any partial payment as agreed upon by contract at the point in time of cancellation. Products not able to be sent in a package shall be picked up. Obligations to refund payments must be met within thirty (30) days. The period begins with the transmission of your statement or cancellation of things for us with their reception.

8. Important notice: under Section 5 (f) 3 of the Austrian Consumer Protection Act, individually produced products (such as, for instance, custom made shirts, custom made blouses, custom suits and custom made boxer shorts) are excluded from the right of withdrawal (cancellation)!

9. Manufacturing tolerances

Shirts, blouses, suits and boxer shorts made by BFB Handels GmbH are always tailored in accordance with the measurements you have specified. If you have selected the body measurements, your shirts, blouses and suits are manufacture according to your chosen style (closely fitted, fitted, normal, and loosely fitted at the waist). If you select to take measurements from one of your garments, the dimensions of your ordered garment (shirt, blouse, and suit) should match with those of your owned garment (shirt, blouse, and suit). However, we cannot warrant that the two garments will be identical with respect to seams and design. Please note that adjustments of the size of up to 1 cm may be necessary. We can not guarantee that the ordered garments based upon the standard sizes in our tables will be a perfect fit. For this reason we recommend that you are using personal measurements, both body measurements and measurements taken from a fitting garment that is part of your clothes. We make every effort to continually improve the quality and design of our garments and our web page. For this reason garments ordered at different times may be slightly different from each other. Garments made from different fabric batches may vary in their shading, due to normal variations in the dyeing process. If other problems than those outlined here should occur we will make every effort to eliminate them as soon as possible, as we wish to render the best possible service to you.

10. Service

11. Legal warranty

Warranty for our products is in line with the statutory requirements. If a fault occurs within the statutory warranty period of two (2) years upon delivery, you are entitled to a supplementary service (choice of correction of fault or new product) and – subject to application of the statutory prerequisites – the statutory right of reduction of the purchase price or rescission, and, if appropriate, damages. If the measurements or design of the garment do not match to the specified measurements for reasons other than those stated above we will offer you a new garment or credit the amount to your customer account. BFB Handels GmbH credits the cost of returning the garment to your customer account if you send the garment in its original packaging using the cheapest possible shipping method. As our customer you are responsible for the measurements you supplied to us.

12. Customer account credit

No credit on your customer account will be paid out in cash or transferred to any third party.

13. Data on personal characteristics

Any data on personal characteristics of our customers are used solely to administrate our customer relations; neither personal data nor e-mail addresses are passed on to third parties.

14. Data privacy, change of address and copyright issues

The customer agrees that any personal data included in the sales contract for the execution of this contract are computer-filed and processed by YOUTAILOR. The customer is obligated to notify us on any change of his/her business or residential address for as long as the contractual transaction has not been fully performed on both sides. If this communication is omitted then declarations are deemed as closed in the event they are sent to the customer's last known address. Any drawings, sketches and other technical documents remain our intellectual property at all times, as do samples, catalogues, leaflets, pictures etc.; the customer is not granted any right whatsoever to use or exploit the work.

15. Force majeure

In case of force majeure, the contract may be deemed to be annulled without any claim for compensation for BFB Handels GmbH or the customer or, alternatively, the delivery period may be extended to reflect the type of force majeure. For BFB Handels GmbH, cases of force majeure are: war, mobilization, terrorist act, stoppage of work, obstruction of transport, restricting trade policies, strike, failure of or delay in deliveries by suppliers of BFB Handels GmbH, natural disaster and, generally, any circumstance, event, cause or consequence beyond our control.

16. Applicable law, jurisdiction

This contract shall be governed by Austrian law. Applicability of the UN Sales Convention shall be explicitly excluded. The contractual language shall be English. The contracting parties agree to Austrian jurisdiction. Any dispute arising from or in connection with this contract shall be settled by such court as is competent as regards the subject matter for the domicile of BFB Handels GmbH and solely locally competent.

17. Severability clause

Should any of the provisions hereof be invalid or unenforceable, the remaining provisions shall remain valid and the Parties shall replace such a provision with another provision the purpose of which shall be as close as possible to the original intention of the Parties.
